Israel Judicial Reform Plans 2023
The Israeli Knesset (Parliament) recently proposed a number of judicial reforms. Israelis think that the proposed reforms will limit the country’s judicial system’s ability to question lawmakers. The reforms give the Knesset the authority to appoint judges at will. The Israeli judicial system’s power, in the opinion of the populace, is being constrained by the recent reforms. Thousands are protesting against the reforms in the nation.
Present Situation
The Supreme Court (SC) of Israel has the authority to overturn laws that contravene the nation’s basic laws under the existing system. 13 laws related to individual liberty are included in basic laws. Therefore, the SC’s authority is crucial for human rights protection.
Planned Recent Reforms
- The Knesset is given complete authority over appointing judges. This comprises judges, members of the bar association, members of the judicial committee, etc.
- The laws passed by the Knesset are not subject to review by the SC.
- The Knesset gains the authority to overturn a Supreme Court decision.
- Proposes appointing legal advisors from independent authorities rather than the Supreme Court or other courts.
- Courts will not hear appeals against government decisions.
